Developments in the German housing market and in particular the lack of affordable housing
continue to be a central issue of our time. It is therefore a top priority not only to grant the richest
stratum of the population a right to the city. Likewise, socially disadvantaged and low-income
people must be successfully integrated into the cities. At the same time, existing resident
structures should be preserved, gentrification processes curbed and involuntary segregation
avoided.
In its theoretical part, this paper shows that effective approaches for the creation and preservation
of affordable housing exist in various areas. Furthermore, social housing in Germany and its
developments are considered. While the theoretical part is supported by an expert interview, the
empirical part is based on a quantitative survey of building authorities in Upper Bavaria. As a
result, the study showed that in many cases there is a need for action as well as improvement
regarding the municipal use of building law instruments to ensure the demand for (affordable)
housing.
In conclusion, stricter and binding guidelines as well as legal application guidelines are necessary
to ensure legal certainty for the municipalities and that the instruments dealt with are used in a
targeted, transparent and consistent manner for the creation of affordable housing.
