Politische, ökonomische und gesellschaftliche Krisen im 21. Jahrhundert erfordern besondere Bewältigungsstrategien, sie erweitern den Handlungsspielraum exekutiver Akteure und schränken rechtliche Kontrollmechanismen ein. Diese Transformation von Souveränität und Recht lässt sich mit der politischen Theorie vom Ausnahmezustand analysieren. Anhand einer Typologie lassen sich neue Ausnahmezustände diagnostizieren, bei denen die Rechtsfolge von Normen außer Kraft gesetzt oder der Prozess der Rechtsinterpretation instrumentalisiert wird. Dieser Theorieansatz kann anhand aktueller ökonomischer Krisen, Krisen im Kontext von Flucht und Migration oder terroristischer Bedrohungen plausibilisiert werden.     «

Political, social and economic crises in the 21st century demand special exceptional strategies, expanding the executive power and limiting the legal control mechanisms. This transformation of the sovereignty - rule of law ratio can be discussed with the political theory of the state of exception. By developing a typology of exceptional situations, new types of exceptional cases can be diagnosed. These new exceptional types are characterized by the suspension of the legal consequence or the misuse of the legal interpretation.
