Abstract:
Die Frage, ob das Grundgesetz zukunftsfähig ist, muss angesichts der digitalen Transformation aufgeworfen werden. Es wurde ein Wandlungsprozess angestoßen, der über eine Technisierung bekannter Sachverhalte hinausgeht und als soziotechnisches Phänomen auch Herausforderungen für den Rechtsstaat bereithält. Die Untersuchung nimmt sich daher der Verwirklichung der Grundrechte in digitalen Kontexten an und zeigt – wo notwendig – Möglichkeiten der Optimierung auf.
Translated abstract:
In light of the ongoing digital transformation, the question of whether the Basic Law is fit for the future arises. The process of change initiated by digital technologies goes beyond the mechanisation of known facts and, as a socio-technical phenomenon, also poses challenges to the rule of law. The study examines the realisation of fundamental rights in digital contexts and - where necessary - identifies opportunities for optimisation.
